
Registered migration agents in Australia work under a Code of Conduct set by law. This page explains what that Code requires of us, what you can expect as our client, and what to do if you are not happy with our service.

The Code of Conduct is a set of legal rules that every registered migration agent in Australia has to follow. It is not a company policy we wrote. It is prescribed by the Australian Government in the Migration (Migration Agents Code of Conduct) Regulations 2021, which took effect on 1 March 2022.
The Code is administered by the Office of the Migration Agents Registration Authority, known as OMARA. OMARA registers migration agents, monitors how they work, and handles complaints about them. An agent who breaches the Code can be cautioned, suspended, or have their registration cancelled.

These are the duties the Code places on us. They are summarised in plain language. The Code itself is the authority.
We must act professionally and ethically, treat you with respect, and not make false or misleading statements to you.
We must comply with migration law and must not give you false or misleading documents or statements.
We must not give immigration assistance that has no realistic prospect of success. If an application is not viable, we have to tell you.
Immigration assistance must be given by a registered migration agent, and our MARN must be shown where the law requires it.
We must not make false or misleading statements when promoting the business.
Registered agents are required to hold professional indemnity insurance.
If there is a conflict of interest in your matter, we have to tell you about it.
Your information stays confidential, subject to the exceptions the law allows.
Where you need an interpreter, we have a duty to arrange access to one.
We must give you the OMARA consumer guide, which sets out your rights when using a registered migration agent.
We must keep you updated on the progress of your matter, and must not cause unnecessary expense or delay.
Before we act for you, we must have a written service agreement setting out the work and the fees. Any variation must be given to you in writing. An initial consultation does not require one.
Fees and disbursements must be set out clearly, and we must give you invoices and receipts. We must not take money from you before the service agreement is in place.
We have specific duties about how client money is held, and about refunds where they are due.
Your documents must be kept securely and returned to you.
We must keep records of our advice to you and maintain your client file.
If our work for you ends, we must give you notice and forward correspondence about your matter.
If our registration is suspended or is expected to lapse, we must notify you, the Department and any review authority.
Be careful of anyone who tells you otherwise.
