Your Questions and My Answers January 2023 Part 1

In this latest blog, I will answer questions concerning migration in Australia.


In this blog, I will be addressing some inquiries listed below:

  1. How long can it take for assessment by the RDA in the direct pathway for offshore 491?

  2. How can I decide the points for my work experience if the work experience is not relevant to my study?

  3. Do you still have a scholarship offer for trade courses?

  4. Is it better to do a diploma or bachelor's in community service to get jobs in the industry?

  5. Does the professional year has an expiry date?


Question: I am a chef. I have completed level 4 cookery and a diploma in hospitality management. If I want to gain more points, would you recommend I do the next Advanced diploma or bachelor's degree?

Answer: You do get 10 points for a certificate in Commercial Cookery or a diploma, and even if you do an advanced diploma, you still get 10 points, so if you do want to increase your points, you will have to do a bachelor's in which case you will get 15 points now Bachelors could take you another one to two years to complete so instead of that if you want to focus on increasing points for your English where you can achieve 10 to 20 points if you have a proficient or Superior English then that might be a better option.

Question: How long can it take for assessment by the RDA in the direct pathway for offshore 491?


Answer: The recent applications we have done in the direct pathway with New South Wales have taken two to three weeks, so they are pretty quick with these nomination decisions.


Question: How can I decide the points for my work experience if the work experience is not relevant to my study? I have seven years of work experience.


Answer: To claim points for your employment needs to be closely related to your nominated occupation, and in most cases, it needs to be post-qualification, so it will depend on what studies you have done and what occupation you have to determine if you can claim employment points or not.

Question: I received 190 invitations on Feb 22, NSW system Analyst (IT). How much take more time for a visa grant?


Answer: As per the current processing times for the 190 Visa, it's taking about 15 months, so under 190, the applications take about 15 months, but in some cases, the decision could be quicker than 15 months.


Question: Do you still have a scholarship offer for trade courses? I will be very willing.

Question: Is it better to do a diploma or bachelor's in community service to get jobs in the industry?


Answer: If you do a diploma in community services or a Bachelor's in community services, your occupation outcome is community work which is on the short-term skilled occupation list, so this occupation is usually available for the 190 Visa or the 491 Visa.


Question: I want to ask, in my passport, my name is Abdul Ghafoor, and my surname is empty. And I have written in EOI as a family name Ghafoor and my given name Abdul. Is it ok all, or should I change my name?

Answer: Your family name has to be Abdul Ghafoor, and you will have to leave the given name blank however, if you get the invitation on this EOI, you will be able to change this when you lodge the visa application.

Question: I completed my skill assessment from ACS for 262113(STSOL)- Systems administrator. Can I apply for 189 for 262112(MLTSSL)- ICT Security Specialist with the existing ACS report card?

Answer: Unfortunately, not. You will have to get a new skills assessment in ICT security specialist if you want to lodge an expression of interest for 189 because your occupation outcome is not eligible for the 190 Visa. The occupation outcome of systems administrator for which you have the skills assessment is not on the MLTSSL list, and you're not eligible to lodge an expression of interest for the 189 Visa.


Question: My husband is in Australia and has a 485 visa. I applied for a partner visa. I am in Canada. What is the processing time right now?


Answer: You have lodged the 485 subsequent entrant visa to be dependent on your husband's 485 Visa, so for the recent ones that we have done, the processing time has been three to four months.

Question: Does the professional year has an expiry date? It is not mentioned anywhere in the program though I have heard from a few people that it has an expiry date. If so, how can we renew it?


Answer: The professional year program expires after four years from the start date, but let's say you were to get a skills assessment. You have a professional year program that you did earlier than four years. You can still use that professional year program certificate for your skills assessment. However, you will not be able to claim points for your professional year program if the start date is more than four years ago.

Question: I am onshore, submitted EOI for Analyst Programmer, and have 75 points for NSW 190. Can I get an invite?

Answer: You have a good chance of getting invited for 190 with 75 points but do try to increase your points as well.

Question: My spouse got a 491 Family sponsored visa granted today; however, I have received a pre-invite from Victoria. As I am a secondary applicant on 491, will this hurt my chances of getting the 190 Victoria nomination?


Answer: If you are in that 491 visa application as the secondary applicant, you also have the same condition: you cannot apply for the 190 or the 189 Visa once for nine months.
