Small Business Owners Stream in ACT

Are you a small business owner in Australia who aspires to become a permanent resident? In this blog, I will discuss the Small Business Stream in ACT for Visa Subclasses 190 and 491.

The Small Business Stream in ACT for Visa Subclasses 190 and 491. This pathway is for migrants living and operating small businesses in the Australian Capital Territory or ACT.


To be eligible for a Small Business Owner Stream in Canberra, you must first meet the Department of Home Affairs criteria.


Department Home affairs criteria are:

-Have a points test result of 65 or higher, inclusive of state nomination points

-Have a positive skills assessment in your nominated occupation.

-Be under 45 years of age

-Meet the minimum English language requirement of competent unless your assessing authority requires the higher level


In addition, to the Department of Home Affairs' demands, you must meet the ACT requirements, which require you to be the majority owner, at least 51% of a registered business located and actively operating in the ACT.


The minimum criteria for Small Business Owners Stream:

-Business activity must be in the ACT; Interstate overseas business activities are not accepted.

-Business must be profitable.

-Business must be paying you a taxable income of at least $26000 in the last six months for a 190 nomination and at least $130000 in the last three months for a 491 nomination.

-You must employ at least one Australian citizen, permanent resident, or New Zealand citizen for at least 13 weeks. For a minimum of 20 hours per week.

-You may employ one or more employees.

-Employment does not have to be continuous.

-The employee must be a resident of Canberra.

-You must provide a statutory declaration confirming each employee's employment and citizenship details.


For a 190 nomination, the requirements are:


-That your business has actively traded in Canberra for at least twelve months from the date you established or purchased the business,

-The business has had a minimum turnover of at least $200,000 for the last twelve months.


For a 491 nomination, the requirements are:


-That your business has actively traded in Canberra for at least six months from the date you established or purchased the business,

-The business has had a minimum annual turnover of at least $100000 for the last six months of business activity

-You must be the majority owner of an eligible registered business in the ACT and claim matrix points in the small business owner category.


You can claim 10 points in Canberra metrics if you run the business for six months and 20 points if you run the business for twelve months.


Please note that business types like sub-tenancy, ride-share, taxi, delivery, courier services, or an on-sold business previously used to qualify for a city nomination are not eligible.


Also, your nominated occupation does not have to be on the ACT Critical Skills list, and you can choose any occupation from the department-eligible occupation list.


The Small Business Owner Stream in the ACT is better than other small business owner visas available in other states. Because if you score high matrix points, you can also apply for a 190 visa, and there is no such condition that you cannot be studying to apply for the nomination under this category.


You could consider this option even if you are on a student visa as long as you meet all the eligibility criteria for this stream. Please note that this stream is open for onshore applicants only.
